Reasons for mediation
Mediation can be used in a wide range of conflicts. Examples include employment disputes, commercial disputes, deadlocked negotiations or situations where communication between the parties has become difficult. Under the guidance of an independent mediator, the parties are given the opportunity to discuss their positions and interests and to work together towards a solution.
A key principle of mediation is that it is voluntary and based on self-determination. The parties themselves remain in control
of the process and decide together what agreements are reached. This often results in a solution that better reflects the wishes and interests of both parties than if a third party, such as a judge,
were to make a decision on the matter.
A mediation process also offers various advantages. For instance, a conflict can often be resolved more quickly than through court proceedings. The duration of the process is largely determined by the parties themselves and can vary from a few meetings to a process lasting several months. As a result, costs are generally kept to a minimum and protracted legal proceedings can be avoided.
